Welcome to Zeloov ("we," "our," or "us"). By accessing or using our website and digital invitation platform (the "Service"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
1. Description of Service and Pricing
Zeloov provides a digital platform that allows Users to design custom, premium event invitations, manage guest lists, and utilize Smart RSVP tracking tools.
All-In-One Flat Fee: Zeloov operates under a single, flat-fee pricing model. Access to full platform functionality, premium design components, and premium invitation distribution tools requires a one-time payment of $14.99 USD per event profile.
Price Modifications: We reserve the right to change the standard flat fee for new event profiles at any time. Any changes to pricing will be explicitly posted on the platform prior to purchase.
2. User Accounts and Account Deletion
Account Responsibility: To access the premium features of the Service, you must register for an account. You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Deletion: Users have the right to permanently delete their account at any time through their Dashboard or by contacting support@zeloov.com. As outlined in our Privacy Policy, account deletion will result in the permanent purging of all associated account data, active digital invitations, and Guest RSVP lists within thirty (30) days.
Event Rescheduling: Users may modify the scheduled date of their event directly through their Dashboard. However, any such date changes must be made prior to the expiration of the original 15-day post-event grace period. If an event date is not updated in the system before this period lapses, the automated system will permanently purge the profile, and data cannot be recovered.
User Responsibility for Data Export: It is the sole responsibility of the User to export and safeguard their Guests' Smart RSVP data, contact lists, and event metrics prior to the 15-day post-event deletion. Zeloov has no obligation to store, maintain, or recover data once the 15-day lifecycle has concluded.
3. Intellectual Property Rights
A. Zeloov Ownership
All intellectual property rights in and to the Service — including but not limited to the Zeloov name, logos, software code, user interface designs, website aesthetics, proprietary design elements, layout mechanics, and structural invitation formats — are and will remain the exclusive property of Zeloov.
B. Limited License
Upon payment of the $14.99 premium fee, Zeloov grants you a limited, non-exclusive, non-transferable, revocable license to use the platform's proprietary design elements solely to create, customize, and distribute digital invitations for your specific personal or commercial event via the provided Zeloov links. You are strictly prohibited from exporting, duplicating, or selling Zeloov's underlying assets, design templates, or code for use outside of our platform.
4. User-Generated Content and Guest Data Liabilities
A. Content Ownership and Responsibility (Including Audio & Music Uploads)
Users may upload personal text, descriptions, schedules, graphics, images, and audio files/background music tracks ("User Content") to customize their digital invitations. You retain all ownership rights to your User Content. However, by uploading any file to the platform, you explicitly warrant and agree that:
You own the uploaded content or possess the explicit, valid legal licenses, rights, and permissions to use and distribute it.
The use of any background music or audio track uploaded by you does not infringe upon the copyrights, trademarks, or intellectual property rights of any record label, artist, or third-party creator.
Zeloov acts strictly as a passive hosting venue for your invitations. We absolutely disclaim any and all liability arising from unauthorized copyright material uploaded by Users.
Copyright Infringement & Take-Down Policy (DMCA Compliance) If Zeloov receives a formal notice from a copyright owner asserting that a User's invitation contains unauthorized copyrighted material (such as an unlicensed song or commercial image), Zeloov reserves the right to immediately suspend, mute, or permanently delete the offending invitation profile or asset without prior notice and without any obligation to issue a refund.
B. Third-Party Guest Data (Smart RSVP)
When using our Smart RSVP or contact management tools, you will upload third-party personal data belonging to your Guests (such as names, phone numbers, and email addresses).
Legal Warrant: You explicitly warrant and represent to Zeloov that you have obtained valid, legal consent from each Guest before uploading their contact information into our system.
Indemnity: You agree to indemnify and hold harmless Zeloov against any claims, liabilities, or legal actions arising from a Guest asserting that their data was processed without their consent.
5. AI-Powered Generation Tools and Disclaimers
AI Design and Content Generation: Zeloov provides AI-powered features that allow Users to generate digital invitation layouts, text, and design elements based on text prompts submitted by the User.
Limitation of AI Accuracy: You explicitly acknowledge and agree that artificial intelligence technologies are subject to inherent limitations. AI-generated outputs may occasionally contain factual inaccuracies, typographical errors, formatting glitches, or visual artifacts.
User Duty to Verify: Zeloov does not review or guarantee the factual correctness or aesthetic flawlessness of AI-generated content. It is the sole and absolute responsibility of the User to thoroughly review, proofread, and verify all texts, dates, names, and design layouts generated by the AI before completing the $14.99 premium activation and sharing the link with Guests. Zeloov disclaims all liability for any errors or damages resulting from unverified AI outputs.
6. Refunds and Cancellation Policy
No Refunds: Due to the digital nature of the Service and the immediate delivery of full platform access and premium asset allocation upon payment, all transactions are final. Zeloov does not offer refunds for the $14.99 premium activation fee once the payment has been completed.
Technical Issues: If a technical error prevents you from utilizing your premium access, please contact our support team at support@zeloov.com, and we will work to remedy the platform defect immediately.
Payment Failures and Chargebacks: Zeloov reserves the right to immediately suspend, restrict, or permanently disable access to any active digital invitation link and its database if the associated $14.99 payment is disputed, flagged as fraudulent, or subject to a chargeback by our payment gateway partners.
7. Limitation of Liability and Disclaimers
"As-Is" Service: The Service is provided on an "as-is" and "as available" basis. Zeloov makes no warranties, expressed or implied, regarding platform uptime, the continuous availability of specific server links, or the compatibility of invitation links across all mobile devices or email clients.
Limitation of Damages: To the maximum extent permitted by applicable law, Zeloov shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the platform, even if advised of the possibility of such damages. In no event shall Zeloov's total liability exceed the amount paid by you ($14.99 USD) for the specific event profile in question.
Post-Event Data Purge and Link Expiration: In order to prevent server overload and maintain optimal platform performance, each digital invitation profile is active for a limited time. The invitation page, its underlying media content (including user-uploaded images and audio tracks), and the associated RSVP data will be automatically and permanently purged from our infrastructure fifteen (15) days after the scheduled event date. Following this 15-day grace period, the invitation link will become permanently inactive, and data cannot be recovered.
Furthermore, Zeloov does not guarantee identical visual rendering, background audio playback, or interface functionality across obsolete web browsers (such as Internet Explorer) or legacy mobile device operating systems. It is the User's responsibility to test invitation layouts on modern devices using standard updated browsers.
8. Governing Law and Dispute Resolution
These Terms and your relationship with Zeloov shall be governed by, and construed in accordance with, international commercial laws and the laws of the jurisdiction in which Zeloov is officially registered, without regard to its conflict of law principles. Any legal disputes arising from these Terms shall be resolved exclusively through binding arbitration or competent courts within our registered jurisdiction.
